These Terms govern your use of OverstockCasters.com (“we,” “us”). By using the site or placing an order, you agree to these Terms.

What OverstockCasters.com is

We operate a business-to-business marketplace that connects buyers with verified third-party suppliers of overstock, surplus, discontinued, and closeout caster and material-handling inventory. Listings are admin-reviewed for accuracy, and the supplier shown on a listing is responsible for the product it sells.

Eligibility

The marketplace is intended for business and procurement use by users who are at least 18 years old and able to enter a binding contract.

Listings, pricing, and availability

Inventory is one-time overstock, so quantities are limited and are not restocked. We work to keep specifications, quantities, and pricing accurate, but listings may contain errors and are subject to change or correction. If a material error affects your order, we may cancel it and issue a refund of amounts paid.

Orders

Your order is an offer to buy. We or the supplier may accept or decline it, including for pricing errors, stock issues, or failed verification. If we cannot fulfill an accepted order, we will refund amounts paid for that order.

As-is sales

Because this is liquidation inventory, items are sold as-is and all sales are final, with condition, quantity, and specifications disclosed on each listing. See our Returns & Refunds Policy. Damage in transit is handled as described in our Shipping Policy.

Disclaimers and limitation of liability

Except as expressly stated on a listing or required by law, the marketplace and the products are provided without warranties of any kind, including merchantability and fitness for a particular purpose. To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential damages. You are responsible for confirming that a lot is suitable for your application before purchase.

Intellectual property

The site, its content, and its design are owned by us or our licensors and may not be copied or reused without permission.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Venue for disputes lies in the state or federal courts located in Texas.
